1. Our Mission & Framework
JobVista is an AI-enhanced recruitment marketplace designed to facilitate trust-based professional connections through advanced verification protocols and simulated skill assessments. Our services are provided to help Jobseekers showcase verified expertise and to empower Employers to discover qualified talent efficiently.
2. Acceptable Use & Professional Conduct
You agree to use the Platform only for legitimate recruitment or career development purposes. JobVista maintains a zero-tolerance policy for fraudulent behavior.
- Anti-Scraping: You are strictly prohibited from using data mining, robots, screen scraping, or similar automated data gathering tools to extract information from our talent pool or job listings.
- System Integrity: You must not attempt to breach Platform security, reverse engineer our matching algorithms, or interfere with our transient AI processing streams.
- Authenticity: All data provided—including resumes, company details, and verification documents—must be accurate and up-to-date. Misrepresentation is grounds for immediate account termination.
- No Commercial Resale: You may not resell access to JobVista’s Talent Search results or redistribute internal platform content without express written consent.
3. Account Registration & Security
You must be at least 16 years of age to create an account and use this Platform. To utilize core features, you must register a professional account. You are responsible for ensuring your login credentials remain confidential.
- Responsibility: You are entirely responsible for all activity occurring under your account.
- Notifications: You agree to notify JobVista immediately ([email protected]) of any unauthorized use or security breach.
- Identity Protection: Sharing account access between multiple individuals is prohibited unless expressly permitted by a specific enterprise subscription tier.
4. User Content Ownership & Licensing
JobVista respects the ownership of your professional digital identity.
- Ownership: You retain all intellectual property rights in your original resumes, company logos, and achievement proofs.
- Operational License: By uploading Content, you grant JobVista a worldwide, non-exclusive, royalty-free license to host, display, and process this data PROTECTIVELY to fulfill matching and recruitment outcomes.
- Verification Artifacts: When you use our Verification Hub, you authorize our system to assess your JPG/PNG artifacts. Once verified, the resultant "Verified Status" remains a proprietary signal owned by the JobVista ecosystem.
5. Interactive AI Services (AI Interview Studio)
Our AI-driven modules, including the Interview Studio and Career Coach, are assistive simulations provided as-is.
- Transient Nature: As specified in our Privacy Policy, AI interview data (voice streams and transcripts) is processed transiently. We do not store transcripts or suggestions persistently.
- No Guarantee: AI feedback is based on simulated performance. It is a developmental tool, not a legal guarantee of job fitness or guaranteed employment outcomes.
- Usage Limits: Interactive sessions are subject to quotas defined by your current account tier.
6. Employer Subscriptions & Talent Search
Employers utilizing JobVista’s Talent Search and recruitment management tools are bound by the following financial and operational terms:
Resource Consumption & Quotas
"Unlocking" a redacted profile or posting a new vacancy consumes non-refundable resource slots. These quotas are refreshed or managed based on your specific subscription plan.
Payment & No-Refund Policy
All payments for subscriptions (Basic, Premium, or Enterprise) and individual resource purchases are final. JobVista implements a strict No-Refund Policy given the immediate delivery of digital recruitment access.
- Billing Cycles: Charges occur at the start of each billing period.
- Cancellation: You may cancel at any time, but you will retain access until the end of the paid period. No partial refunds are provided.
7. Platform Intellectual Property
All elements of the JobVista Platform—including site architecture, UI/UX design, matching algorithms, the "JobVista Verified" badge system, and proprietary AI layering—are the exclusive intellectual property of JobVista. You may not copy or reproduce our design language or technical workflows.
8. User Authenticity & Prohibited Conduct
All users must provide truthful, accurate, and complete information when creating profiles, uploading documents, or interacting with the Platform.
Jobseeker Obligations
- No False Identity: You must not create a profile using false personal details, fabricated qualifications, or another person's identity. Impersonation of any individual is strictly prohibited.
- Document Integrity: All uploaded documents — including resumes, certificates, licenses, and employment records — must be genuine and unaltered. Submitting forged, doctored, or misleading documents is grounds for immediate account termination.
- Consequences: Violation of this section may result in permanent account suspension, removal of all associated data, and where applicable, referral to the relevant legal authorities.
Employer Obligations
- No Fraudulent Job Postings: Employers must not post fictitious, misleading, or "ghost" job vacancies. Every listing must represent a genuine, currently open position.
- Accurate Company Information: Company profiles, descriptions, and contact details must be truthful and up-to-date.
- Reporting: Users may report suspected fraudulent job postings via the reporting feature available on each job listing. JobVista will review all reports and take appropriate action, which may include removal of the listing and suspension of the employer's account.
9. Verification Disclaimer
The "Verified" badge, trust scores, and related verification indicators displayed on the Platform are automated confidence signals generated from user-submitted data. They do not constitute a background check, identity guarantee, professional endorsement, or certification of any kind.
JobVista's verification tools provide preliminary trust indicators to help streamline the hiring process. These tools assist but do not replace employers' standard hiring and due diligence procedures. Employers are responsible for independently verifying candidate credentials before making hiring decisions.
10. Third-Party Job Sources
JobVista may display job listings sourced from third-party platforms and external feeds. While we endeavour to present accurate and current information, we do not guarantee the accuracy, completeness, or availability of externally sourced listings. JobVista is not responsible for the content, hiring practices, or conduct of third-party employers whose listings appear on our Platform.
11. Account Termination & Suspension
JobVista reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or otherwise poses a risk to Platform integrity — with or without prior notice.
- Data Handling: Upon termination, your data will be handled in accordance with our Privacy Policy.
- Paid Subscriptions: If your account is terminated due to a violation of these Terms, no refund will be provided for any remaining subscription period.
12. Service Availability & Disclaimers
We aim for high availability but provide the platform “AS IS” and “AS AVAILABLE”.
- Uptime: We do not guarantee uninterrupted access and may restrict usage for maintenance without prior notice.
- External Content: JobVista is not responsible for the accuracy of third-party job listings or the conduct of users outside our verified framework.
13. Limitation of Liability
To the maximum extent permitted by law, JobVista and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the Platform, including but not limited to loss of data, missed employment opportunities, or recruitment failures.
14. Indemnification
You agree to defend and hold harmless JobVista against any claims, losses, or expenses arising from your misuse of the Platform, violation of these Terms, or infringement of any third-party rights.
15. Modification of Terms
We may modify these Terms periodically. Substantial changes will be communicated via Platform notifications. Continued use after such updates constitutes your acceptance of the revised Terms.
16. Governing Law & Jurisdiction
These Terms and any dispute or claim arising out of them shall be governed by and interpreted in accordance with the laws of New Zealand, without giving effect to any choice or conflict of law provision. You agree that any legal proceedings related to these Terms shall be submitted to the exclusive jurisdiction of the courts of New Zealand.
